1. What the service is
Hosts.ky is software that imports your bookings from your Airbnb calendar and transaction exports, calculates the Cayman Islands Tourist Accommodation Tax for each stay at the statutory rate, tracks the filing deadlines, and produces the Department of Tourism (“DoT”) return form as an Excel or PDF file for you to file. It also helps with entry codes and housekeeping around each stay.
Hosts.ky does not file anything. It does not submit returns, make payments to DoT, or communicate with DoT on your behalf, and it is not a tax adviser.
2. Your account
- You must be at least 18 and operate, or act for someone who operates, licensed tourist accommodation.
- Sign-in is by one-time email code or Google. Keep control of that email account; anyone who can read it can sign in as you. You can sign out every device from Settings.
- During the closed beta, accounts are created by invitation. We may decline or close beta accounts at our discretion.
- You are responsible for the accuracy of what you enter or import, including operator details printed on the return.
3. Your responsibility for tax filings
The return Hosts.ky produces is a draft prepared from your data. You review every figure, sign the return and file it with DoT yourself, and you pay the tax. The filing deadline, the accuracy of the return, and any surcharge, penalty or interest for a late, missing or incorrect filing are your responsibility, whatever Hosts.ky showed or did not show.
We work hard to keep the rate, the form and the deadline rules current, and we show two dates for every period — a recommended file-by date and DoT’s deadline — but DoT’s published rules and your own registration always take precedence over anything in the app.
4. Acceptable use
- Use the service only for accommodation you operate or are authorised to manage, and only with data you are entitled to process.
- Do not attempt to access other accounts or data, probe or overload the service, or reverse-engineer it.
- Do not upload anything unlawful or malicious. Uploads are limited in size and type.
- Guest data you enter must be collected fairly — for example, a phone number copied from a reservation for use during the stay, in line with the platform’s rules.
5. Plans, prices and billing
Hosts.ky is a paid subscription. Accounts we have marked as complimentary (for example beta testers) use it free until we say otherwise. For everyone else:
- Prices are in US dollars and shown before you subscribe. The Personal plan covers up to two properties.
- A valid payment card is required to subscribe and your card is charged when you subscribe. There is no free trial.
- Subscriptions renew automatically monthly or yearly until cancelled. Upgrades take effect immediately and are prorated; downgrades and cancellations take effect at the end of the current billing period, with no refund for the remainder.
- Refunds: yearly plans are refunded pro-rata if you cancel within 14 days of purchase; otherwise, and for monthly plans, payments are non-refundable.
- Payments are processed by our payment provider; we never see or store your card number. Prices exclude any tax that applies to you.
- If a payment fails we will retry and email you; access may be limited until it is settled.
6. Your data
Your bookings, figures and returns are yours. You can export everything at any time and delete your account from Settings; how we handle personal data is set out in the Privacy Policy, which is part of these terms. We keep nothing after your account is deleted except what the law requires or what remains in provider backups for up to 30 days.
7. Data processing terms (for guest data)
For the personal data of your guests you are the controller and we are your processor under the Cayman Islands Data Protection Act. We undertake to:
- process guest data only to provide the service to you and on your documented instructions (including the settings you choose in the app), and never for our own purposes;
- keep the sub-processor list in the Privacy Policy current, and email you at least 30 days before adding one, so you can object or leave;
- apply the security measures described in the Privacy Policy and make sure people with access are bound by confidentiality;
- help you respond to guests’ requests about their data, and forward any request we receive to you within 48 hours;
- tell you without undue delay, and in any case within 5 days of becoming aware, of any personal data breach affecting your guests, with the information you need to notify the Ombudsman and the people affected;
- delete all guest data when your account is deleted, as described in the Privacy Policy, and provide an export first if you ask;
- make available the information needed to show we meet these obligations, on reasonable request.
You confirm that you have a lawful basis to collect the guest data you put into Hosts.ky and that your instructions comply with the law.
8. Availability and changes
We aim to keep Hosts.ky available around the clock but do not guarantee it; there will be maintenance and there may be outages. We may change or retire features. If we discontinue the service we will give you at least 30 days to export your data.
9. Warranties and liability
Hosts.ky is provided “as is”. To the fullest extent the law allows, we make no warranty that it is error-free or that any return it produces is correct, complete or accepted by DoT, and we exclude all implied warranties.
We are not liable for any tax, surcharge, penalty, interest or loss arising from a late, missing or incorrect filing or payment, nor for indirect or consequential loss, lost profits or lost data. Our total liability to you for any claim connected with the service is limited to the fees you paid us in the 12 months before the claim (or US$100 if you paid nothing). Nothing in these terms excludes liability that cannot be excluded by law.
10. Ending the agreement
You can stop using Hosts.ky and delete your account at any time from Settings. We may suspend or end your access if you break these terms, if the law requires it, or with 30 days’ notice for any other reason; in the last case we will refund any prepaid fees for the unused period. Sections 3, 6, 7, 9 and 11 survive termination.
11. General
- These terms are governed by the Province of Ontario and the federal laws of Canada applicable therein, and disputes are resolved in its courts, without affecting any consumer rights you have where you live.
- We may update these terms; material changes are emailed at least 30 days ahead and you will be asked to accept them on your next sign-in. Continuing to use the service after that date means you accept them.
- If any part of these terms is unenforceable, the rest still applies. Our failure to enforce a term is not a waiver.
- These terms, with the Privacy Policy, are the whole agreement between you and us about the service.
